"occupy oakland" faces off with city council. how a meeting to save jobs was derailed. >> and no major accidents as you head out but roadwork could slow you down. we'll tell you about it coming up. >> high pressure and more clouds. what does it mean? we'll talk about that in just a moment. >> good morning. it's thursday, january 26. i'm frank mallicoat. >> i'm grace lee. sheriff ross mirkarimi is going to have a new lawyer today in court. anne makovec explains the san francisco sheriff is fighting to be reunited with his family. anne joins from us san francisco. reporter: good morning. today is a big deal with all the players involved. sheriff mirkarimi is being forced to stay away from his

wife and son. they all want to be together as a family because she is denying the accusations. today's court hearing could lift that protective order. mirkarimi has only been in office since january 8 and is charged with three misdemeanor counts after an incident on new year's eve when he is accused of bruising his wife's arm in front of their 2-year-old son. he had to turn in his guns but despite public and political pressure, he is planning to stay on as sheriff although he says he wouldn't collect any pay during his trial which is set to start february 24. now, the list of witnesses came out yesterday including mirkarimi's wife eliana lopez but again she is so far denying the charges against him. mirkarimi's ex-girlfriend is also expected on the stand, christina flores. she has a similar accusation of abuse. then there is i'very madison the neighbor who brought this case to police after she says

mirkarimi's wife came to her house asking her to photograph that alleged bruise. also on the witness list another neighbor, some domestic violence experts and investigators. and frank, as you mentioned, there is going to be a new lawyer at mirkarimi's side today, lidia stiglich a lawyer from berkeley. he apparently parted ways from his former lawyer, bob waggener. >> thank you, anne. san diego police are charging two men with beating a uc-berkeley student during christmas break. 18-year-old grant richmond was attacked outside a friend's home last month. doctors really didn't expect him to survive but the san diego "union-tribune" reports he is now in rehab and is improving. the suspects are charged with the attack on richman and a number of other people that same night. relatives of a man killed by bart police are filing a wrongful death suit. 45-year-old charles hill was shot to death at bart's civic center station in san

francisco. that happened july 3. officials say he had threatened officers with a knife and bottle before he was shot. hill's brother is suing the transit agency for unspecified damages. and new this morning, the president of iran says he is readyhave talks with world powers -- to have talks with world powers about his country's nuclear program. iran is facing tough sanctions. mahmoud ahmadinejad says they won't force iran to give in to western demands. a united nations nuclear agency team is expected to visit iran this weekend. legal probe into the san bruno pipeline explosion now has a new leader with close ties to california public utilities commission. commission president michael peavy appointed himself to be in charge of the investigation. he has led the agency since 2003. federal and state reviews faulted the commission's oversight in the past. pg&e could face millions of dollars in fines for violating safety rules tied to that 2010

blast. representatives from pg&e and public utilities commission are expected to answer some more questions tonight during a forum in palo alto. they are set to explain some new safety measures implemented after the 2010 explosion that left eight people dead and destroyed dozens of homes. the forum starts tonight in palo alto at the city hall at 6:00. the city of oakland is scrambling to come up with a plan to deal with a huge hit to its budget as protestors crashed a meeting on budget cuts. gil diaz reports from outside city hall, with a plan to save jobs and programs. reporter: good morning. it was already a tense and heated meeting last night at the city council meeting but things got uglier and noisier when "occupy" protestors stormed in. the protestors' shouts forced the city council to take a 30- minute break. mayor jean quan did not return to the meeting after the recess. the meeting focused on how to

cut $28 million from the budget. and the city has until february 1 to figure it out. the city administrator suggested consolidating departments and cutting several programs such as children's fairyland and oakland's zoo. but before abandoning the meeting, mayor quan tried unsuccessfully to explain the budget situation to the crowd. >> even some of the unions here tonight, your parent unions agreed to the elimination of redevelopment because one group has been -- one group has been pitted against another. >> reporter: it turns out the number of layoffs that the city had originally thought of doing is less. 81 jobs now at risk instead of the 100 to 200 range. now, local union 1021 feels that the city council is rushing to making some budget cut decisions. it issued a statement last night. "we want to help the city find solutions that work, but we still need information and time

up. in the meantime let's talk about the weather. here's lawrence. >> it's been so nice. yesterday a fantastic day. those temperatures running a good five to seven degrees above average even some 70s into the monterey bay. now the clouds have moved back in, thick, too. temperatures are staying mild at this hour but skies are mostly cloudy even some patchy, dense fog and drizzle at the coast. we are in the 50s right now. high pressure starting to flatten out allowing for a few more high clouds spilling in on the top of the ridge and sea breeze kicking in. we are going to cool down the temperatures for today, not all that bad, sneaking in some sunshine by the afternoon, 60s into san jose and santa clara. also those temperatures up in the 60s in the east bay and you get inside the bay, the temperatures in the 50s and the 60s. this weekend, guys, those offshore winds are going to blow! it is going to be some kind of weekend. we'll tell you more about that in a few minutes. >> what's snapping. >> winds blowing offshore, you'll love it! how vandals ruined a mural design by kids in the south

bin laden freed the hostages yesterday. we'll hear from jessica buchanan's father this 30 minutes. two buildings several stories high have come crashing down in brazil last night. two people are feared dead in rio de janiero. witnesses heard a loud explosion before the collapse which could have been caused by a natural gas leak. the city as mayor says the buildings collapsed due to structural damage. 5:11. arizona's governor gets an earful from president obama. this meet and greet on the tarmac turned very tense yesterday afternoon. reporters on scene say both kept interrupting one another and at one point governor jan brewer pointed her finger at the president. this may have started after the president expressed his disappointment with her book. >> i would never be disrespectful in that manner. >> did he walk away from you at the end? >> i i believe that when we were in the conversation that i was in the middle of a sentence and he walked away. >> a white house official says the president noted that brewer

ross mirkarimi argues to go back sheriff time for our top stories. today san francisco sheriff ross mirkarimi argues to go back home. the embattled sheriff will be in court with his new attorney. he is fighting to lift the order against contact with his wife and his 2-year-old son. oakland police have a $1 million warrant for suspected kill remon mcdaniel wanted for killing an east oakland man on january 4. republican presidential candidates are taking center stage in their final debate in florida. this is tonight just before the primary. it's expected to be a two-man

battle between mitt romney and newt gingrich. voters could decide the fate of california's high-speed rail project. the secretary of state approved an initiative for signature gathering to begin on a voter referendum. it would eliminate the 98 billion-dollar project to connect passengers from san francisco to l.a. more than 800,000 signatures are needed to be submitted by june 21 to qualify for the state ballot. california is trying to clear the wear cleaner cars. the state -- clear the air with cleaner cars. the state will vote on whether to require vehicles that emit three-quarters less smog producing pollutants by 2025. the rules will mandate that one of every seven new cars sold in the state be zero emissions or hybrids. let's check the roads with elizabeth. >> the golden gate bridge, there is a lot of fog this morning across the deck.

our live "timesaver traffic" traffic cameras show you traffic heading into san francisco. problem southbound 101 by cochran road there is a mattress in the road so not sure if that's what caused the accident but there are lanes blocked. no slowing on the sensors but watch out for that in the southbound lanes. heading into san jose, quiet on northbound 280, 101 looks good. guadalupe parkway, no major issues across the south bay except for the one accident. taking you back outside live in the commute direction of westbound 92 about 13 minutes off the high-rise. quiet in both directions. at the bay bridge lower deck roadwork that has yet to be wrapped up. otherwise in the commute direction westbound 80 obviously no delays. no metering lights yet. so you're good to go across the

deck heading into san francisco. remember kcbs once you do hit the roads. they're our radio partners. and you can find them at 740-am and 106.9-fm. did you get a chance to enjoy the sunshine yesterday? >> i did. i took a walk, it was beautiful. >> it was fantastic. those temperatures running a good five to seven degrees above average for today. the clouds have moved back in and we are seeing some of that thick fog out there. temperatures are mild. this afternoon cooler temperatures partly cloudy skies 50s and 60s. the ridge of high pressure bringing us nice weather is flattening out a bit. that's allowing for some cooler air to begin to move onshore and a few more clouds. the rain line for the most part is going to stay to the north. so we'll stay dry in the bay area and that means some nice weather. 55 in redding, 65 sacramento, 61 fresno. toward the bay area those temperatures running into the 60s as you head to the south bay, mid-60s even into morgan

hill. 50s at the coast. east bay, 60s this afternoon with partial clearing. inside the bay another good day but not as warm as it's been. temperatures warming up as early as friday. offshore winds blow a bit and that means we're looking good into the weekend. that may clear us out, get this guys, all the way to the coast on saturday. patchy fog at the coast on sunday. then cooling off monday, tuesday, wednesday. but no rain in sight. >> you're excited. >> no more coffee for you. >> cut him off now. getting a face-lift since 2006 the san francisco planning department has been working with organizations to explore improvements to the area and now it's moving on with its next phase of detailed design. >> what this design does is really prioritize the need for pedestrians, gives them more space, provides new amenities, new public seating, new generous spaces for restaurants to overflow out into the street. it's really a chance to bring a whole new diversity of level and life to the street that's not there now. >> it will move along jefferson street stretching between powell and hyde streets. the plan hopes to make the area more enjoyable and easily accessible for all the visitors and the local businesses down on the wharf. 5:20. you work hard for the money! isn't that a song. >> donna summer. you want to break into it? >> no. >> but how that can actually backfire on you in the long run. >> something you won't see at walmart any more. what the big box store is

okay, guys. companies that received federal government bailouts still owe taxpayers nearly $133 billion. the official in charge of the

$700 billion bailout says some of that money will never be recovered. the treasury department now trying to sell off its stake in more than 450 bailed-out companies. more people are work longer hours and that may be hurting their mental health. researchers followed 2,000 british workers that compared people who worked 11 hours a day or people who just worked 8. the chances of depression were more than double in those who worked those extra hours. so enjoy your time off. >> yes, we will. welcome to walmart. that's a greeting late night shoppers are not going to be hearing thanks to a new money- saving move. bloomberg reports that the big box chain is pulling greeters off the overnight shifts. about 3,000 workers have been reassigned to other roles like stocking shelves. one spokesman says the idea is to have more staff on shifts at busier times. the tradition of greeters dates back to 1980 with the goal of making the stores feel friendlier. a modesto woman gives salvation army a gift they will

good morning, everyone. thursday, january 26. i'm frank mallicoat. >> i'm grace lee. the time is 5:29. we begin with the second time this week san francisco sheriff is heading to court. >> he returns this afternoon to ask for permission to finally go back home. anne makovec in san francisco where ross mirkarimi has a new lawyer. >> reporter: this is the first time he will appear with berkeley lawyer lidia stiglich after he parted ways with a lawyer that brought him thus far. the big deal about today's hearing is that it is about that protective ordering forking him to stay away from his wife and son. a judge could decide to lift that protective order. mirkarimi charged with three misdemeanor counts right now, domestic violence battery, child endangerment and dissuading a witness that's after that incident on new year's eve when he is accused of bruising their wife's arm in front of their 2-year-old son. he turned in his guns. despite pressure, he is planning to stay on as sheriff. so he says he won't collect any

the courtroom today? >> reporter: as far as i know, the media will not be allowed into the courtroom today. everybody always tries to talk to mirkarimi and his lawyer on the way into and out of the courtroom. and i'm sure that will be attempted today. at first, he was very open to talking. and he has been a little more tight-lipped. we'll see how his new lawyer deals with this, lidia stiglich. the hearing begins at 2:30 this afternoon. >> thank you, anne makovec in san francisco. testimony will continue today in a high-profile murder trial in san francisco, as well. andrew bologna broke down in tears yesterday's testified against the alleged gunman who shot and killed his father and two brothers. polonia said he saw edwin ramos open fire on his father's car as they drove home from a family outing in 2008. prosecutors allege the suspected ms-13 gang men mistook them for live gang

"occupy" protestors stormed into the meeting chanting and shouting forcing the council to take a break and mayor quan didn't return to the meeting

afterwards. council chambers packed with more than with more than 100 people. the council was prepared to hear from 65 people who signed up to speak but the disruption slowed down the process. the city attorney says the city seniority rules are still trying to be figured out, they probably won't know who has a job until the end of next week. back to you. >> thank you. the man who will decide whether pg&e will be fined for that deadly explosion in san bruno is also in charge of the

well so a mess there by cochrane. no major delays on the sensors north- or southbound 101. coming into san jose through downtown it looks okay. out of downtown san jose on 280 quiet. a few more headlights on 280. all those cars heading towards cupertino. 101 guadalupe parkway still problem-free, delay-free. we have macworld 2012 kicking off today by south of market in san francisco. so there are street closures in the area and muni reroutes. howard street is closed between 3rd and 4th and expect muni delays if you are in the area as well for the next few days. outside a live look through milpitas, westbound 237 a lot of our cameras are socked in with fog this morning. visibility is a problem heading out the door. westbound 237 no delay from milpitas to san jose. coming up we check mass transit. in the meantime, lawrence has a check. foggy forecast. >> elizabeth were you thinking about doing the bangs thing

an ice rink. this happened in slovakia. a youth hockey team ran to safety... as heavy snow brought down the ceiling. nobody was hurt. just one day after reporting record profits... apple is coming under fire for its working conditions in china. the new york times reports this morning that workers.. some as young as 15... have been plagued by long hours, unsafe working conditions and even physical punishments. the profile also details that dozens have been injured and a handful killed in explosions and other accidents at the plants. apple says it has adopted a code of conduct for its suppliers. cleaning up california cars... the state's air resources board is set to vote on new rules that would require automakers to build cars and trucks by 2025 that emit about three- quarters less smog producing pollutants.
